Under Act 47 of 2025, amendments to the Pennsylvania Public School Code place new restrictions on students who are habitually truant from transferring to a cyber charter school during the school year.
What Has Changed?
- A student is considered habitually truant if the student has six (6) or more unexcused absences.
- A student who is habitually truant may not transfer to a Pennsylvania cyber charter school during the school year.
- An exception may occur only if a judge determines that the transfer is in the best interest of the student.
These provisions apply specifically to transfers into state-authorized cyber charter schools and are intended to ensure continued attendance accountability and support for students experiencing attendance difficulties.
What Families Should Know
- This law does not eliminate cyber charter schools as an option for families.
- Students with more than six unexcused absences cannot enroll in a cyber charter school mid-year without court approval.
- Attendance laws and truancy procedures remain in effect for all students enrolled in the District.
